At this early stage, the changes are creating uncertainties and application difficulties, including checks on proceedings that risk being extinguished if a lawsuit is not filed, defense strategies to be rethought in order to deal with the new “filters” of the preliminary hearing and pre-trial hearing, case-by-case evaluation of possible ways out of the trial, starting with alternative rites and probation, and new digital filings, with technologies that do not always work properly, while waiting for the telematic penal process to be fully implemented.
