Puccio Penalisti Associati, with a team composed of the Founding Partner Andrea Puccio, the Senior Associate Francesca Tomasello, and the Associate Alessandro Ruffini, obtained the annulment of the emergency seizure order issued by the Public Prosecutor’s Office of Brescia and validated by the Judge for the preliminary investigations against the Dall’Era Group (a group that has been operating for over 40 years, both in Italy and abroad, in the processing and commercialization of steel products).
The criminal proceedings, filed at the Brescia Public Prosecutor’s Office and charging the Board of Directors’ Chairman and the other Directors of the Company Società Siderurgica Dall’Era, with the offenses of fraud, fraudulent insolvency, and self-laundering, the latter of which is also charged against the Companies pursuant to Legislative Decree n. 231/2001, originated from the submission of some complaints by two of the Companies’ suppliers, in relation to certain orders of steel materials.
In November 2024, the Public Prosecutor issued an emergency seizure order, subsequently validated by the Judge for the preliminary investigations, based on several alleged crimes. As a result, a precautionary measure had been imposed against all the individuals under investigation, the Company Società Siderurgica Dall’Era, as well as against the holding Company Fratelli Dall’Era, for an amount of over €2 million. The order was promptly enforced by the Guardia di Finanza, causing the complete leading to the complete paralysis of the Companies’ operations and the freezing of all corporate and personal bank accounts.
In response to the seizure order, Puccio Penalisti Associati filed a petition for review on behalf of the Directors and of the Companies, claiming several aspects of illegitimacy of the precautionary measure and seeking its annulment.
Following the hearing held on February 25, 2025, the Court of Review of Brescia issued an order whereby, upholding all the defense’s requests, it annulled the seizure order, ordering the immediate release of all seized funds, both in favor of the individuals and the companies involved.
